EXCELLIS TRAVEL — TERMS OF SERVICE
(Customer | Partner | Corporate Client Terms)
1. Introduction and Acceptance
These Terms of Service (“Terms”) constitute a legally binding agreement between:
Excellis Travel Private Limited, Ecostation Building, 15th Floor, Unit no 1504, Sector V, Salt Lake, Bidhannagar, Kolkata, West Bengal, India (Hereinafter referred to as “Excellis Travel”, “Company”, “we”, “our”, or “us”)
AND
Any person, entity, corporate customer, travel agent, reseller, partner, or user (“User”, “Customer”, “Partner”, “Corporate Client”, “you”, “your”) accessing or using our website, portal, mobile application, APIs, or services.
By accessing, browsing, registering, booking, purchasing, or using any service offered by Excellis Travel, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
2. Scope of Services
Excellis Travel acts as an intermediary platform facilitating travel-related services including but not limited to:
- Airline ticketing
- Hotel bookings
- Visa assistance
- Tours and holiday packages
- Transportation services
- Corporate travel management
- Travel insurance facilitation
All services are subject to availability and governed additionally by the terms and conditions of the respective third-party suppliers.
3. User Categories Covered
These Terms apply equally to:
3.1 Individual Customers
End consumers booking travel services for personal use.
3.2 Travel Partners / Agents
Registered resellers, agencies, consolidators, or intermediaries booking on behalf of travellers.
3.3 Corporate Clients
Companies, institutions, and organisations using Excellis Travel for employee travel, group travel, or managed travel services.
4. Authority and Representations
You represent and warrant that:
- You have full legal capacity to enter into this agreement.
- If booking on behalf of another person/entity, you have valid authorisation.
- All information provided is accurate, complete, and lawful.
- You shall inform travellers of all charges, restrictions, cancellation terms, and supplier rules before booking.
5. Booking, Pricing and Payments
5.1 Dynamic Pricing
All prices are subject to real-time availability, supplier pricing, exchange rates, taxes, and regulatory charges.
5.2 Payment Obligations
Bookings are confirmed only upon successful receipt of full payment.
5.3 Payment Gateway Charges
All payment gateway/service fees are non-refundable under any circumstances.
5.4 Wallet / Credit System (Partners)
Where wallet-based systems apply, failed bookings may result in credits rather than refunds, subject to supplier settlement timelines.
6. Cancellations, Amendments and Refunds
6.1 Supplier-Controlled Policies
Cancellations and refunds are governed primarily by airline/hotel/operator rules.
6.2 No Guarantee of Refund
Refund eligibility depends entirely upon supplier approval. Excellis Travel does not guarantee refunds.
6.3 Amendment Fees
Any modification after confirmation may incur:
- Supplier penalties
- Excellis Travel service fees
- Fare difference charges
6.4 No-Show Policy
Failure to cancel before departure/check-in deadlines may result in total forfeiture.
7. Partner Responsibilities and ADM Policy
Partners shall be solely responsible for:
- Duplicate bookings
- Fake/fictitious passenger names
- GDS misuse
- Segment churning
- Ticket issuance errors
Any Agent Debit Memo (ADM) imposed by airlines/GDS shall be borne fully by the Partner.
8. Visa and Immigration Disclaimer
Excellis Travel’s role is strictly limited to documentation facilitation.
- Visa approval is solely the discretion of consulates/immigration authorities.
- Visa fees are non-refundable.
- Excellis Travel bears no liability for rejection, delays, deportation, or denial of entry.
Partners/Customers indemnify Excellis Travel against all immigration-related penalties.
9. Limitation of Liability
To the maximum extent permitted under Indian law:
- Excellis Travel is not liable for acts, omissions, negligence, delays, overbooking, cancellations, or deficiencies of third-party suppliers.
- Excellis Travel shall not be liable for indirect, consequential, punitive, or special damages.
Maximum Liability Cap
In any circumstance, Excellis Travel’s total liability shall be limited to: INR 1,000 (Rupees One Thousand Only) or the service fee charged by Excellis Travel, whichever is lower.
10. Force Majeure
Excellis Travel shall not be liable for failure or delay caused by events beyond reasonable control, including:
- Natural disasters
- War, riots, terrorism
- Pandemics
- Government restrictions
- Airline shutdowns
- System failures
11. User Conduct
Users shall not:
- Misuse the platform
- Upload malicious software
- Violate intellectual property rights
- Engage in fraud, chargebacks, or abuse
- Post defamatory or unlawful content
Excellis Travel reserves the right to suspend or terminate access immediately.
12. Intellectual Property
All trademarks, branding, software, content, and platform design remain the exclusive property of Excellis Travel.
Unauthorised reproduction, resale, or commercial exploitation is strictly prohibited.
13. Indemnification
You agree to indemnify and hold harmless Excellis Travel, its directors, officers, employees, and affiliates from any claims arising from:
- Traveller misconduct
- Partner booking errors
- Visa/document failures
- Supplier disputes
- Fraudulent transactions
- Chargebacks
14. Dispute Resolution and Jurisdiction
14.1 Arbitration
Any dispute shall first be resolved through arbitration under the Arbitration and Conciliation Act, 1996.
14.2 Exclusive Seat and Jurisdiction
All disputes, claims, or legal proceedings shall be subject to the exclusive jurisdiction of courts at Bidhannagar, West Bengal only. No other court shall have jurisdiction.
15. Amendments
Excellis Travel reserves the right to modify these Terms at any time without prior notice. Continued use constitutes acceptance.
